Candidates Privacy policy

We are committed to providing clear and transparent information regarding the use of the personal data provided to us. This Privacy Policy informs about how we process your personal data when you interact with us by submitting your curriculum vitae (CV) for its inclusion in a recruitment process we may publish.

2.- What is the purpose of processing your data?

At FIRA CIRCUIT, we process the data you provide to include it in the active recruitment processes we currently have or that we may open in the future.

Additionally, we may ask you to take a psychometric test to ensure the best alignment between our candidates’ natural styles and the behaviors required for the various job positions.

Your data will be processed at all times under strict confidentiality, with the necessary technical and organizational measures in place to protect such data, in compliance with Regulation (EU) 2016/679 of April 27, 2016, on the protection of individuals with regard to the processing of personal data and on the free movement of such data (“GDPR”), and its Spanish adaptation through Organic Law 3/2018 of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights (by its Spanish acronym “LOPDGDD”).

3.- How long will we retain your data?

Your data will be kept for the duration of the active recruitment process, and in the event, you are not selected for the position you applied for, it will be retained for a maximum period of twelve (12) months from the completion of your application. This allows us to contact you regarding future vacancies, provided you have given your prior consent.

After the twelve (12) month period, your data will be automatically and securely destroyed unless your CV has been re-entered into an active recruitment process.

4.- What is the legal basis for processing your data?

The legal basis for processing your personal data is the application of pre-contractual measures, as you have applied for a vacancy with the intention of potentially being selected for a position at FIRA CIRCUIT.

Your data may also be processed based on your consent in the following cases: (i) when you gave us consent for retaining your CV for future vacancies; and (ii) when you have consented to taking the aforementioned psychometric test as detailed in section 2.

In some cases, we may ask you to provide your employment history report to verify your work experience, based on our legitimate interest.

To assess this legitimate interest, we have conducted a balancing test that analyzes the benefits to us as the Data Controller, as well as the benefits to third parties. This test concludes that our legitimate interest in processing the data outweighs the interests, rights, and freedoms of the data subjects and/or third parties.

You may request further information on the legitimate interest balancing test by contacting the Data Protection Officer (DPO) at the address provided in the corresponding section of this Privacy Policy. Additionally, you have the right to object to processing based on legitimate interest.

5.- To whom will we disclose your data? Will your data be processed outside the EEA?

Your data will not be shared with third parties. It will only be processed internally by FIRA CIRCUIT. If FIRA CIRCUIT needs to share your personal data with a third-party service provider, your data will be shared under strict confidentiality and only after entering into a relevant contract between the Data Controller (FIRA CIRCUIT) and the Data Processor (service provider). The service provider will only process your data to fulfill the contract and not for its own purposes.

If any of our service providers processes personal data in a third country outside the European Economic Area (EEA), FIRA CIRCUIT will apply all necessary measures to protect your personal data. The main measures FIRA CIRCUIT adopts for international data transfers include the signing of standard contractual clauses approved by the European Commission, adherence to international agreements or Adequacy Decisions, or requesting certifications or codes of conduct approved and recognized.

6.- What are your rights when you provide us with your data?

Any individual has the right to obtain clear and understandable information about whether their personal data is being processed by FIRA CIRCUIT.

Interested parties have the right to access their personal data, request rectification of inaccurate data or, if applicable, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was provided. You also have the right to withdraw your consent at any time. Additionally, you can exercise your right to object to the processing of your data for sending marketing information via electronic means.

You may also exercise the right to limit the processing, meaning your data will not be deleted but its processing will be limited, as well as the right to data portability, allowing you to obtain your personal data in a structured, commonly used and machine-readable format and transmit it to another data controller of your choice.

FIRA CIRCUIT does not carry out automated decision-making based on your personal data.
